Jack Daniel's Ruling Raises Survey Reliance Question

Douglas Masters, managing partner of Loeb & Loeb’s Chicago office, is featured in Managing IP discussing the strategic role of trademark dilution claims in parody cases, as highlighted by a recent ruling that found VIP Products, a dog toy company, diluted Jack Daniel’s trademarks but did not infringe them.

“Dilution is a claim that has a lot of merit and strategic value to the extent there could be some weaknesses in an infringement case,” he notes. “This case highlights the separate and unique value of dilution claims.”
