Loeb & Loeb successfully defended NBCUniversal against a $14 million copyright infringement lawsuit brought by Providence Publications, which alleged hundreds of infringements spanning a decade.
Providence Publications claimed that NBCUniversal improperly forwarded copyrighted works without a license. After both parties filed cross-motions for summary judgment, the U.S. District Court for the Central District of California ruled in favor of NBCUniversal, finding that the company had both an express license to forward the works on a nonprofit basis and an implied license based on Providence’s repeated written confirmations that such forwarding was permitted.
