NEW YORK – Loeb & Loeb LLP announced today that David G. Mallen, the deputy director of the National Advertising Division (NAD) of the Council of Better Business Bureaus (CBBB) and an experienced attorney in the areas of advertising and consumer protection law, has joined the firm as a partner in the New York office. Mallen brings with him nearly 15 years of experience from NAD, the advertising industry’s self–regulatory body, which investigates and adjudicates issues relating to truth and accuracy in advertising.
“David’s distinguished background enhances our ability to service clients on cutting-edge matters involving the convergence of advertising and promotions, emerging media, technology, privacy and consumer protection law,” said Kenneth R. Florin, co-chair of Loeb & Loeb’s Advanced Media and Technology Department.
James D. Taylor, co-chair of the firm’s Advanced Media and Technology Department, added: “David will be a great resource to help clients understand how to effectively develop strong messaging in order to avoid or overcome competitive or regulatory challenges in marketing and advertising, and he brings a unique skill set to help clients secure positive results if challenged.”
While at NAD, Mallen was responsible for the review of a broad range of national advertising campaigns in traditional and new media. He has analyzed legal, communication and claim substantiation issues and resolved disputes between advertisers in a number of industries, including dietary supplements, food and drug products, telecommunication services, consumer household products, and computer and Internet technology. Mallen is also recognized for his counseling services and subject matter expertise in the challenging areas of sustainability and green marketing and technical claim substantiation. As NAD’s Deputy Director, Mallen was a representative of the Advertising Self-Regulatory Council, a self-regulatory system that works to establish the policies and procedures for regulating the advertising industry.
“David is an exceptional addition to our firm,” said Loeb & Loeb Chairman Michael D. Beck. “He brings invaluable knowledge and insight to our marketing, advertising and regulatory practice and will further strengthen our already top-notch bench in these important areas.”
A thought leader within the marketing and advertising industries, Mallen is an in-demand speaker and lecturer at high profile legal and trade association events. He has been a featured speaker at the ABA Consumer Protection and Antitrust Law events, the PMA Marketing Law Conference, the Intellectual Property Owners annual meeting, International Chamber of Commerce events, the Global Advertising Lawyer’s Alliance, and the Sustainable Brands Conference, among other legal and marketing workshops and seminars. In addition, Mallen is active within the leadership of the American Bar Association’s Section of Antitrust Law. He currently serves as the Vice Chair of the Private Advertising Litigation Committee and regularly chairs panels at the Section’s Spring Meetings.
“Loeb & Loeb has built an impressive practice that addresses a wide array of issues in the advanced media, advertising and marketing fields,” said Mallen. “They are at the forefront of this very dynamic industry and I am looking forward to returning to private practice and becoming a part of Loeb’s continued leadership in the space.”
Admitted to the bars of New York State and the Southern and Eastern Districts of New York, Mallen earned his J.D. from Albany Law School of Union University, and his B.S. from Cornell University.
