Cal. Civil Code § 22.2 provides: “The common law of England, so far as it is not repugnant to or inconsistent with the Constitution of the United States, or the Constitution or laws of this State, is the rule of decision in all the courts of this State.” The statute was originally enacted in 1849 and remains on our books. The speakers will address some examples of how particularly in cases of first impression it can continue to play a decisive role in the evolution of our law.
