Obtained Order Granting Opposition to Plaintiff’s Motion for Summary Judgment

Represented the owners of a multi-million dollar wind turbine tower manufacturer, in successfully obtaining an order denying plaintiff’s motion for summary judgment in a breach of contract action. Plaintiff sued to recover funds loaned to the manufacturer and personally guaranteed by its owners. The Northern District of California agreed that plaintiff’s motion for summary judgment was not sufficiently supported and that defendants’ anticipatory breach defense presented a genuine issue of material fact to withstand summary judgment.
