Overview
Successful appellate representation — whether defending a hard-won verdict or challenging a questionable loss — often begins long before a case reaches the appellate court. Shaping legal theories to withstand appeal while preserving critical issues that provide grounds for challenge strengthens a party’s position from the outset.
Loeb & Loeb has a proven track record of winning cases both in trial courts and on appeal. Our veteran appellate attorneys are experienced trial lawyers who bring long-range vision and critical thinking, deep substantive backgrounds, and sophisticated written and oral advocacy to their work. From beginning to end, we work with clients to anticipate and develop issues at all stages of litigation to ensure that their cases are best positioned for appellate success.
While known for our ability to see our clients’ cases through from start to finish, we are often retained after trial to handle post-trial proceedings and appeals. We also frequently represent clients on amicus briefs, working with them to weigh in on key issues that help shape the law in areas of vital importance. We are experienced in interlocutory matters, including writ applications and emergency requests for provisional relief.
Our appellate attorneys — many of whom served as law clerks in appellate courts as well as in the business and government sectors — have argued cases before the U.S. Supreme Court and in nearly every federal appeals court as well as in state appellate courts across the country. We bring a diversity of thought and experience to every matter we take on. We also counsel and represent clients in judicial reviews of agency decisions, orders and rulemakings filed in the U.S. Court of Appeals, proceedings that frequently involve difficult questions of appellate jurisdiction and procedure. Our team is well-versed in those issues, with significant experience bringing petitions for review, intervening in petition proceedings and appearing as amicus curiae.
We represent clients ranging from individuals to Fortune 500 companies in a variety of industries. We also advise government entities, including states, cities and municipal agencies, as well as entities in the nonprofit sector.
Our team handles trials and appeals in a vast array of substantive areas, including complex commercial litigation, white collar criminal defense, real estate, government and public-sector issues, antitrust claims, patent and other intellectual property disputes, professional liability matters, health care, transportation disputes, and trade and commerce restrictions.
We understand our audiences, our adversaries and our clients — and this shapes our advocacy and drives our ability to achieve the best possible outcomes through the appellate process.
