Loeb & Loeb successfully represented rapper Roddy Ricch, as well as Atlantic Records, Warner-Tamerlane, Kobalt Music Publishing, Peermusic and other writers and producers, in a recent lawsuit claiming the rapper’s 2019 song "The Box" copied elements from the 1975 song "Come On Down" by Greg Perry.
The lawsuit, filed in December 2022, claimed similarities in melodies, chord progressions and instrumentation, but the judge granted a motion to dismiss that Loeb filed on behalf of its clients, concluding that those musical elements were dissimilar under the "ordinary observer" test.
The Loeb litigation team that represented Roddy Ricch included Barry Slotnick, chair of the Intellectual Property and Entertainment Litigation practice, Litigation partner Tal Dickstein and associate Alexander Loh.
