Loeb & Loeb is pleased to welcome Kimberly Eney to the firm’s San Francisco office as a partner in the Nonprofits and Tax-Exempt Organizations practice group. Eney’s practice encompasses advising a diverse range of tax-exempt organizations, philanthropists and nonprofit leaders on tax and corporate matters, enabling them to advance their mission, reflecting her long-standing commitment to the nonprofit sector.
Eney maintains a particular focus on helping private foundations, companies, and family offices navigate the federal tax regime applicable to foundation grant-making, investments, and operations. She advises on the establishment and maintenance of grant-making programs and the execution of complex grant agreements and transactions, and she assists with structuring and maintaining impact investing programs, including program-related investments (PRIs) and mission-related investments (MRIs). Eney also advises on other aspects of the tax laws, such as the formation of new tax-exempt entities and compliance with laws related to donor-advised funds and supporting organizations; international activities; self-dealing transactions; the use of affiliated entities, including limited liability companies and Section 501(c)(4) organizations; lobbying and nonpartisan voter education; related party transactions and the intermediate sanctions regime; fiscal sponsorships; and the unrelated business income tax. She advises a broad range of clients in the tax-exempt space, including scientific research and healthcare organizations; media, entertainment, and sports-related organizations; and foreign organizations. She also advises executive teams and boards on the development of good governance practices and the resolution of board disputes.
“We are thrilled to welcome Kim to our dynamic and growing EO group. This strategic addition reflects the firm’s commitment to bicoastal expansion in the nonprofit space, significantly boosts our collective expertise in high-demand areas such as family philanthropy, and expands our ability to serve a wide range of tax-exempt clients.” said Diara M. Holmes, Co-Chair, Nonprofits & Tax-Exempt Organizations practice and Co-Chair, Attorneys of Color and Ethnic Diversity Affinity Group.
“I’m excited to join Loeb & Loeb. With a highly sought after trusts and estates practice and former leaders of the IRS Exempt Organizations division and Charities Bureau of the New York Attorney General’s office, the firm is uniquely positioned to provide well-informed and sophisticated advice for non-profit organizations, fiduciaries, donors, and corporate sponsors.” said Eney. “Much of my work has been dedicated to supporting others seeking to create positive impact in the world, and that’s something I look forward to continuing at Loeb with a talented group of colleagues who are leaders in our field.”
Eney previously served as vice president of legal for Fidelity Foundations, a group of family foundations and philanthropies focused on charitable investments in areas such as conservation, art, education, life sciences, and international grant-making. She oversaw legal compliance with respect to grant-making and grants management, board governance, and general contracts.
“We’re pleased to welcome Kim to our growing San Francisco office,” said Nicole Webb, San Francisco office administrative partner. “The addition of a deeply experienced attorney like Kim enhances our ability to provide top tier service to our exempt organizations, family office and philanthropist clients on the West Coast.”
Eney earned her A.B. from Brown University and her J.D. from New York University School of Law. Prior to joining Loeb & Loeb, Eney was a partner at Morgan Lewis where she advised tax-exempt organizations for a span of time totaling over a decade.
