Privacy Issues in the Use of Artificial Intelligence

Loeb’s Brian Heidelberger, chair of Advertising, Marketing & Promotions; partner Caroline Hudson; Jessica Lee, chair of Privacy, Security & Data Innovations discuss the privacy issues that accompany the rapid advancement and adoption of artificial intelligence (AI) in businesses.

Artificial intelligence has been a conversation for decades. However, the overwhelming adoption of generative AI tools like ChatGPT and more advanced neural networks have sparked concern across industries as it relates to how personal data is collected and managed, data privacy, intellectual property and other legal liability issues.

As more businesses seek to streamline their processes with AI, there are several AI-specific laws and regulations rapidly being introduced to consider. This includes the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA) and the EU AI Act which continues to advance in legislation.
