Overview

Mark Ressler is a nationally recognized trial lawyer and litigator whose practice spans a wide range of cutting-edge technology matters and high-stakes commercial disputes. Mark has over 30 years of experience successfully representing companies, financial firms, real estate developers and government entities in some of their most complex and challenging matters. A former federal prosecutor, he is also an accomplished criminal defense lawyer who represents clients in white collar and regulatory investigations.

As chair of the firm’s Software Litigation practice, Mark helps companies and government entities address the business disruptions and financial losses resulting from failed Enterprise Resource Planning (ERP) software implementations. He has become the counsel of choice for companies, states and municipalities seeking to obtain recovery from software providers and implementers involved in mission-critical projects plagued by delayed or failed go-lives, soaring costs, project management lapses, missing functionality, excessive customization, defective interfaces and other problems.

In addition to ERP matters, Mark regularly handles disputes involving logistics, supply chain and transportation issues, representing third-party logistics companies (3PLs), less-than-truckload (LTL) carriers, freight brokerage firms and e-commerce companies.

Mark also has a notable real estate litigation practice, and has represented major New York City developers and owners in high-profile joint venture, investment, lending and construction disputes.

Mark previously served as an assistant U.S. attorney in the Eastern District of New York, where he handled significant corruption, insider trading and racketeering murder-for-hire prosecutions.

  • Copart in a four-week federal jury trial resulting in a $20 million verdict against Sparta Consulting and its parent, KPIT Infosystems, for fraud and professional negligence stemming from an implementation of SAP software.
  • State of Hawaii in an action alleging fraud, False Claims Act violations and other claims against technology firm Ciber and its insurers stemming from an implementation of Oracle software for the State’s Department of Transportation, resulting in a $31 million recovery, exceeding the $7 million Hawaii paid to Ciber for the failed ERP project.
  • National Grid in actions against multiple software vendors stemming from a $1 billion implementation of SAP software.

  • XPO Logistics and GXO Logistics in multiple state and federal court litigations stemming from disputes over warehouse management services contracts, WMS solutions, transportation contracts, theft of trade secrets and non-compete agreements.
  • The Georgetown Company, a leading real estate company, in winning a fraud counterclaim on summary judgment against construction firm J.T. Magen stemming from a construction project at 787 11th Avenue in Manhattan.
  • The Lubrizol Corporation, a leading a global specialty chemicals company, in defending against multiple state and federal toxic tort actions in Illinois stemming from a massive 2021 fire in Rockton, Illinois.

  • SL Green Realty in a litigation against a major gaming company stemming from the bidding process to run New York’s Aqueduct racetrack casino.
